Terms of Service

1. Acceptance

By creating an account or using the Hey Be Safe service ("the Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using it, you represent that the email address you register is one you control and that the information you provide is accurate.

3. Your account and credentials

You are responsible for safeguarding your master password. The Service is designed so that we cannot reset or recover your master password; if you lose it, you will lose access to your encrypted data, and we cannot help.

4. Acceptable use

• You may not use the Service to store materials whose mere possession is unlawful in your jurisdiction.
• You may not use the Service to circumvent security on systems you don't own or aren't authorised to access.
• You may not scrape, crawl, or otherwise automate access to the Service in ways that disrupt normal operation.
• You may not attempt to reverse-engineer the Service for the purpose of finding and not disclosing vulnerabilities — coordinated disclosure to support@milcreto.com with subject [security] is welcomed.

5. Service availability

The Service is provided on a best-effort basis. We do not offer a service-level agreement (SLA) on the free tier. We may schedule maintenance windows and may discontinue features with reasonable notice.

6. No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free from security breaches.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MILL CREEK TECHNOLOGY LLC AND ITS AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNTS YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICH ON THE CURRENT FREE TIER IS ZERO.

8. Indemnification

You agree to indemnify and hold harmless Mill Creek Technology LLC, its affiliates, and their officers, employees, and agents, from any claim arising out of your breach of these Terms or your misuse of the Service.

9. Termination

You may close your account at any time via Safe Settings or by emailing support@milcreto.com. We may suspend or terminate accounts that violate these Terms. On termination, your account data is deleted within 30 days; backups expire within 90 days.

10. Governing law and venue

These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Maryland for any disputes arising out of these Terms or the Service.

11. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will continue in full force.

12. Changes

We may update these Terms from time to time. Material changes will be announced by email. Continued use after the change date constitutes acceptance.
